On November 22, 2016, a Texas federal district court entered a nationwide, preliminary injunction barring the Department of Labor (DOL) from implementing and enforcing the revised regulation changing the salary threshold for overtime eligibility from $23,600 to $47,476. State of Nevada v. U.S. Department of Labor, 4:16 CV 00741. The DOL’s revised regulation was scheduled to take effect December 1, 2016. The injunction will most likely stay in effect throughout the course of this legal challenge, including the appeal process.
Pending a final result of this matter, the Division of Agriculture will not be implementing the changes that were previously discussed in regards to changing some employees' statuses from exempt to non-exempt or changes in salaries.
